only delivered it to about 5,000, i have proof of this
i also have an email from them stating they would deliver to 40,000, they refuse to refund me or do anything for that matter
what can i do to them legally? is this a criminal offense (fraud for example) or just civil?

Sounds like false advertisement and if you have documented evidence of this you can take them to small claims courts
One thing to keep in mind is if the cost of court out weighs the cost of the refund then is it worth it?
Sounds like a civil contract issue, you may have to file suit in the state/ county where the business is located unless the company has sufficient contact with your state

This is not a criminal matter. You’ll have to sue. The only way it would be consider criminal is if a prosecutor could prove that they have a history of running this same scam. It’s difficult to prove but can be done, though.
I would sue, report the company to the state Attorney General, and report to the police department (just in case they’ve gotten similar complaints in the past). I would also call your District Attorney’s office and discuss it with the White Collar Crimes Division if they have one.
Just be prepared that the police and DA will tell you it is a civil matter and not criminal.
